PUMP RENTAL TERMS AND CONDITIONS

Renter hereby agrees to the following terms and conditions:

· Renter agrees to rent the Pump listed above from Your Pregnancy and Beyond, LLC (“Lessor”) for a period of _______ after the date of shipment (each 4 week period shall be referred to herein as a “Rental Period”).

· The Pump will be delivered to Renter. Renter has 48 hours after receipt of the Pump to notify Lessor if Pump is damaged or defective. If Pump is damaged or defective, Renter will return Pump to Lessor (Lessor will provide shipping label), and Lessor will deliver a replacement Pump to Renter . In the absence of such notice, Pump will be deemed to have been delivered in good operating condition.

· If Renter fails to return the Pump at the end of the Rental Period, the credit card on file will be charged for another Rental Period. If Renter fails to return the Pump after two Rental Periods, Lessor will charge the credit card on file for the current suggested retail price for the Pump.

· Renter acknowledges and agrees that the Pump can only be used with the Dual HygieniKit Milk Collection System. Manufacturer will not honor warranty if any other system is used. Renter may purchase this system for an additional cost of $47.50 by initialing here. ________

· At the end of the Rental Period, the Pump shall be returned in the same condition in which it was received. Renter agrees to pay a $15.00 cleaning fee upon return of pump. Renter agrees to pay all repair costs if Pump is returned damaged.

· Lessor will supply Renter a shipping label for Renter to use in returning the Pump (inclusive in the cost of rental).

· Renter shall handle the Pump with the utmost care and will be responsible for the current list price of damaged or replacement parts during the Rental Period and upon return of the Pump.

· Renter will notify Lessor promptly of any changes to information set forth on the face of this Agreement, such as change of address, phone number, or credit card information.

· The Pump shall at all times remain the property of Evenflo Company, and Renter shall have no right, title or interest in the Pump, except as set forth in this Agreement.

· Renter shall not allow any other person to use the Pump, nor shall Renter remove the Pump from the state without prior consent of the Lessor.

· EXCEPT AS PROVIDED HEREIN, USE OF THE PUMP IS AT RENTER’S OWN RISK. LESSOR HEREBY DISCLAIMS (I) ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND (II) DAMAGES DUE TO INJURY.

· Renter agrees to pay all fees, including collection, attorneys’ fees, and court costs, incurred by Lessor in enforcing the terms of this Agreement.
